The European Parliament has decided to amend Directive 2011/16/EU on administrative cooperation in the field of taxation (DAC7).
The main purpose of the amendments is to implement a more effective tracking and taxation of sales that are made through an online platform. Currently, the European Parliament plans to oblige digital platforms to report the income received by sellers of goods and services. Those online platforms that are not part of the European Union are required to register and report their activities in the single market in one EU member state, as well as to conduct economic activities in the selected state. Moreover, MEPs decided to provide for coordinated sanctions against platforms that fail to comply with their reporting obligations.
Tax authorities, in turn, are obliged to exchange information with each other. In the case of a request, the tax authorities must provide an answer not later than 3 months from the date of receipt of the request.
It is expected that by the end of 2022 the Commission will prepare a report assessing how well the system works in different countries, including how effective the exchange of information is.
